Patent Overseas Application

Patent rights are territorial. Therefore, filing a patent in Malaysia only provides the patent owner rights to patent in Malaysia. Therefore, the applicant must file a similar patent to other countries of interest within a stipulated timeframe, depending on the method used.

Paris Convention: If the applicant files patent overseas using Paris Convention, it must be done within 12 months from the first patent application date.

Patent Corporation Treaty (PCT): If the applicant files patent overseas using PCT, it must be done within 30 months from the first patent application date.

Duration:

Up to 1 month from instruction date depending on the requirement for translation of patent specification.
